JUDGMENT

JUSTICE SHRI. K.R. UDAYABHANU:  PRESIDENT

Revision petitioner is one of the complainants in CC.20/09 in the file of CDRF, Idukki.  The complaint filed by the Revision Petitioner and 4 others stand dismissed.  There was delay of 288 days in filing the restoration petition before the Forum.  The Forum has dismissed the application on the ground that the delay stands not explained properly.

2.      It is the case of the Revision petitioner that he was laid up due to hyper tension.  The Forum has observed that even if the petitioner was laid up the other complainants could have represented the matter before the Forum.

3.      In view of the fact that the grievance of the complainants stands not examined we find that it would be appropriate to set aside the order of the Forum on payment of cost of Rs.500/- to each opposite parties ie Rs.1500/- in total.  On payment of cost the Forum will take the matter back to file and dispose of the same on merits.  The Forum will issue notice to the opposite parties.  The matter stands posted before the Forum on 6/5/2011.
