This appeal has been filed against the judgment of the

learned DCF, Jaipur 2nd dated 7.5.2015 .

 

The contention of the appellant is that bill Ex. 1 was issued on 13.7.2011 in which Rs. 910/- were shown due from earlier months and during course of arguments it has been shown before the court below that in November 2010 the due amount against the respondent was Rs. 855/-. The contention of the appellant was that when the money was due against the respondent they were right in disconnecting the phone.

 

Heard the counsel for the appellant. None appeared on behalf of the respondent . Perused the impugned judgment as well as the original record of the case.

 

Facts are not in dispute that bill Ex. 1 has been issued on 13.7.2011 and due date for payment was 4.8.2011. The complainant respondent has deposited the amount on 22.7.2011 but inspite of this his connection has been withdrawn on 25.7.2011. No reasonable explanation has been given for the same, hence, the court below has rightly held that it was deficiency on the part of the appellants. Hence, there is no merit in this appeal and liable to be rejected.

From the facts of the case it is implicitly clear that it was negligence on the part of the appellants and they were deficient in service inspite of this appeal has been filed without any valid ground just to chase the consumer . Hence, the appeal is dismissed with Rs. 5000/- cost.
