Accused Sri. Shivalingaiah, S/o. Nanjundappa, Aged about 50 years, BEO, Kolar and the Complainant are present.  Case is advanced to today.  Plea of accused is recorded and accepted.

It is seen that in CC No. 108/2011 on 02.09.2011 this Forum has directed the OP2 to deduct certain amount from the  JDr-1 and to pay to the Complainant. In spite of that and in spite of Execution Application 25/2012 and notice being served, he has failed and omitted to comply with the Order.  Now accused submits that he is unaware of the same and he is going to deduct the amount from the Salary of JDr-1 and pay to the Complainant and DHr submits that if the amount is deducted from the salary of the JDr-1 and paid to the Complainant, he will satisfy.  The said statement of both the parties is recorded. Hence, we pass the following order:

ORDER

NBW is recalled.

Accused is convicted for the offence punishable u/s. 27 of the C.P. Act and sentenced to pay fine of Rs.2,000/-, in  default, to undergo simple imprisonment for 3 months.
