Member : Smt. Jhumki Saha. F I N A L O R D E R 1. The instant case was filed by complainants U/S 12 of the C.P. Act, 1986 wherein the complainants have prayed for direction upon the o.p.no. 2 for installation of a separate electric meter in his name at holding no. 3/1, Bangalpara 2nd Bye Lane, P.S. Shibpur, P.O. Santrgachi, Howrah. 2. The o.p. nos. 1 & 2 in their written version contended interalia that there is no deficiency in service as the complainants have a civil dispute with the O.P. nos. 3, 4 & 5; that in view of the MASD bill inspection was fixed on 24-06-2013 but the same could not be held for the objection raised by the other O.Ps. 3. The O.P. nos. 3, 4 & 5 in their written version contended interalia that the property is not a joint property ; that the same belong to Debjani Khan ; that the complainants filed a suit for partition before the ld. Civil Judge, Sr. Division, Howrah, being T.S. 45 of 2013 ; that the complainants were allowed to stay in a room as a licensee by Debdas Khan since deceased. So the complaint should be dismissed. 4. Upon pleadings of both parties two points arose for determination : i) Is there any deficiency in service on the part of the O.Ps. ? ii) Whether the complainants are entitled to get any relief as prayed for ? DECISION WITH REASONS : 5. Both the points are taken up together for consideration. Admittedly the complainants are the licensee in one room within the holding. The predecessor-in-interest of the O.P. Debdas Khan since deceased allowed the complainant to reside in the same room ( para 9 of the written version ). It is now a settled principle of law that even a licensee is also entitled to electricity. It is immaterial if the complainants are not co-sharers to the property in dispute. Pursuant to their application before the O.P. no. 2, MASD Bill was prepared. If the complainants are not supplied with electric connection in garb of the pendency of the civil suit, the purpose of the beneficial legislation shall be frustrated. Therefore, we are of the view that this is a fit case where the prayer of the complainants shall be allowed. Both the points are accordingly disposed of. Hence, O R D E R E D That the C. C. Case No. 188 of 2013 ( HDF 188 of 2013 ) be and the same is allowed on contest as against the O.P. nos. 1 & 2 and dismissed on contest as against the O.P. nos. 3, 4 & 5 without cost. The O.P. no. 2 be directed to install separate electric meter in the name of the complainant at holding no. 3/1, Bangalpara 2nd Bye Lane, P.S. Shibpur, P.O. Santrgachi, Howrah, or alternatively to install the electric meter within the occupied portion of the complainant within 30 days from the date of this order. If there be any resistance by anyone or by the O.P. nos. 3, 4 & 5 against such supply of electricity in the premises as above of the complainants by the O.P. nos. 1 & 2 i.e., CESC Ltd., then the CESC Ltd. shall be at liberty to take necessary assistance and protection from the I/.C., Chatterjeehat P.S., Howrah. The I/C, Chatterjeehat P.S., District – Howrah, shall be under obligation to provide necessary assistance and protection to the men and officers of the CESC Ltd. for providing such supply to the complainants.
