J U D G M E N T.

Complainant filed Consumer Complaint U/s 12 of C.P. Act, 1986 seeking following relief to take precautionary measures to avoid life & property of complainant and her family members.
Brief fact of the case is that, complainant is a consumer of O.P. having Consumer No. BL 71035 & paying electricity dues to O.P. regularly. The complainant came to know that O.Ps decided to install pole on the village pathway adjacent to her residence to provide electricity power supply to another man Sri Sambhunath Gupta endangering her life & property as well as the life of the children & passerby on the road. Hence, this complaint.
O.P. stated in their show cause that the consumer complaint is non- maintainable before the Forum as her allegation is with regard to supply of 11 K.V. line to another person. As per order dated 13.02.2020 of this Forum Executive Engineer-Cum-Deputy Electrical Inspector submitted his inspection report on 31.08.2020.
It has been found that the vertical clearance of the overhead line does not have any significance as it does not pass above or adjacent to any building or part of a building. Further it is to be mentioned that the horizontal clearance between the nearest conductor and any part of such building has been maintained as per Regulation – 61.
As electricity of 11 K.V. line of electricity department to give new connection to another consumer who is living near the complainant’s house and as per inspection report of Executive Engineer there is no harm to the complainant’s building as the horizontal clearance between the nearest conductor and any part of such building has been mentioned as per Regulation-61.
As there is no harm to the house of complainant. So the prayer of complainant is already fulfilled by O.P. So consumer complaint is dismissed with no cost.
