Complainant files hazira through Advocate.

No step is taken by the O.P. who is found absent on repeated call.

No W.V. has been filed within the statutory period.

The case is taken up for Ex-Parte hearing.

The Complainant’s case is that her daughter Tamoghna Paul took admission on 13/09/2023 to Digital Learning conducted by O.P. on payment of Rs.94,000/- through Credit Card @EMI of Rs.5,222/- per month. On 24/09/2023 Cancellation Request of continuation of the Learning course was sent to the O.P. with the refund request of Rs.94,000/-. Though the learner was unwilling to take delivery of the Course Product but it was delivered on 07/11/2023. The Complainant has therefore approached this Commission for appropriate relief.

O.P. did not turn up to contest the case.

Perused the petition of complaint and other materials on record.

Heard the Ld. Advocate for the Complainant.

Cancellation Request for the Learning Course is found within time and as such the Complainant is entitled to get the refund of Rs.94,000/-  from the O.P. However O.P. may deduct the charges of the delivered Course Product as it was not intimated by the Complainant before its delivery.

Hence it is ordered…….

That the case be and the same is allowed Ex-Parte against the O.P. without cost.

The O.P. is directed to refund Rs.94,000/- to the Complainant with Litigation Cost of Rs.2,000/- after deduction of charges of the delivered Course Product if any within a month from this date in default law will take its own course.

Both parties be supplied copy of this Order free of cost.
