Ld. Counsel for the applicant/petitioner United India Insurance Company Ltd., Bankura Branch prays the instant MA/1/2023 dated 04.10.2023 arising from Appeal A/28/2023 and submits by filing the instant petition supported by an affidavit that since the direction of this Commission, DCDRC of the scope has been complied with by the appellant/applicant and the awarded amount in favour of the OP of the Appeal A/28/2023 i.e. the complanant of CC/79/2017 Bulbul Pramanic has been paid up as awarded as per direction of the Ld. DCDRC. So, necessary order/necessary direction may be passed to return back the amount of Rs. 94,488/- to the petitioner/applicant i.e. United India Insurance Company Ltd., Bankura Branch since at the time of preferring the Appeal A/28/2023 against the judgement of CC/79/2017 applicant deposited the said amount as stipulation through Bank Draft.

Perused the availabe materails on record. Considered.

Perused the final order passed in IA/47/2023  arising from A/28/2023 i.e. arose from CC/79/2017 and I have also perused the filled up form II dated 08.08.2022 filed from the end of the applicant on 04.10.2023 and also perused the account report regarding calim disbursement submitted by the applicant/appellant vide transaction dated 25.09.2023 in favour of the paid Bulbul Pramanic and considering all these I feel inclined to entertain the insant Petition of the Appellant/Applicant in this MA/1/2023 dated 04.10.2023 and accrodingly it is allowed.

Office of this Commission is directed to return the said deposited amount of Rs. 94,488/-  in favour of t he applicant since applicant has already complied the awarded amount as revealed from the available materials on record.

Accordingly, this instant petition being No. MA/1/2023 is thus disposed of.

Office is directed to do the needful.
