          Complainant present.  Opposite party absent.  Complainant has produced copy of his requisition submitted by him to the Commercial officer, BSNL, Cochin dated 21-05-2011.  The complainant has submitted that the opposite party has hither to done nothing in furtherance of the said request.

          We think it is incumbent upon the opposite party to appoint an arbitrator under S. 7B of the Indian Telegraph Act as pointed out by the Hon’ble Supreme Court in N. Krishnan V. General Manager, BSNL.   We are surprised why such a long time is taken by the opposite party for appointing an arbitrator.  It is hoped that the opposite party will fall in line with the intendment of the judgment  delivered  by the apex court of the county and appoint a qualified person as arbitrator to adjudicate the matter espoused by the complainant

          To conclude, opposite party is directed to appoint a qualified  person  as arbitrator, on or before 30/09/2011  for the just disposal of the dispute raised in the complaint NO. 38/2011 pending before this Forum.  In view of the aforesaid direction to the opposite party, the complaint is disposed of accordingly.
