Complaint under  Sec.12 of the CPA 1986 as amended upto date

          Complainant is the Consumer of BSES vide electric connection no. 100490 335 installed at the premises bearing no. 2349, Sadar Nala Road, Bagichi Raghunath, Sadar Bazar, Delhi – 110 006 in his name.

It is alleged by the complainant that he had received a bill of Rs.250/- and Rs.380/- in the month of March and April, 2014 and the same was deposited by him.

 It is further alleged by the complainant that he received a bill of Rs.1610/- and Rs.3400/- in the months of May and June, 2014, and as such he filed a complaint with the OP to make necessary rectification in the bill for the months of May and June 2014, the OP gave him an assurance that it will look into the matter, but nothing was done.

The complainant also filed a complaint with CGRF on 24.6.2014 but no action was taken by the OP .  Finally, the complainant sent a reminder dated 19.7.2014 to the OP to correct the bill amount for the months of May and June, 2014, but all in vain.

The complainant has prayed that he is a poor handicapped person and is ready to pay the electricity dues on his account subject to their correction/rectification by the OP and hence this complaint.

OP has contested the complaint and filed a W.S. Para no. 4 of the reply on merits filed by the OP is relevant and same is reproduced as under: 

4. That in reply to the contents of Para 4 of the complaint it is most respectfully stated that admittedly the bills for the month of May 2014 for Rs.1610/- and again from June 2014 for Rs.3400/- were raised on the basis of actual readings recorded from the meter installed at the premises of the complainant and those pertain to peak summer period when the consumption of electricity tends to be on the higher side.  It is pertinent to mention here that the complainant failed to pay the electricity bill for the month of June 2014 and July 2014 which got accumulated and therefore the respondent company had to sent a notice (Copy attached by the complainant) dated 1.7.2014 for disconnection under S.56 of the Electricity Act 2003 for non-payment of dues of Rs.3400.   That as per the records maintained by the respondent company there are dues presently to the tune of Rs.8810 to be paid by the complainant.

     Both the parties have filed their evidence by way of affidavits.

     We have heard arguments advanced at the bar and have perused the record.

      The counsel for the OP has contended that the electricity bill which the complainant has challenged are based on actual consumption basis and were charged on the basis of monthly reading recorded from the meter installed at the premises of the complainant.  He has contended that there is no overcharging as has been alleged by the complainant.

     The counsel for the OP has also placed on record the copy of consumption pattern of the complaint from May 2011 – September, 2015 in support of his contention.

     We have perused the documents and we are in agreement with the contention of the counsel for the OP .  The bare perusal of the copy of consumption pattern makes it clear that the OP company had raised the electricity bill as per the monthly reading recorded from the meter installed in the premises.  It is pertinent to point out that the complainant had got the electricity meter tested and has filed a report which had confirmed that the meter was giving correct reading.

      We see no deficiency in services on the part of the OP. The complaint is accordingly dismissed

 File be consigned to record room.
