PRESENT:-None.  

          The  perusal of the complaint reveals that the complainant Sh. K. Lalchandani has alleged deficiency on the part of OP/BSES for raising demand of electricity consumption amounting to Rs. 2,83,276/- (Rupees Two Lakh Eighty Three Thousand Two Hundred Seventy Six Only) on his electricity connection  CA No. 400074469. Secondly, it has been alleged that the OP is not recording the name of the new owner Ms. Suman Gupta, in the electricity connection to whom Flat is stated to be sold by the complainant. The Annexure-I i.e. electricity bill enclosed with the complaint shows that the same  is in the name of one Sh. Chander and it also indicates that the demand  of Rs. 2,83,276/- raised by BSES is for theft of the electricity. Further, as regards the name of new owner which is sought  to  be  recorded  in  the record of electricity

connection, the complainant has  himself stated  in  the complaint  that the request has been denied by OP due to non payment of said demand of Rs. 2,83,276/-. We see that the whole issue pertains to the demand in question i.e. Rs. 2,83,276/- which is not in the name of  complainant  and moreover it pertains to the alleged theft of electricity which constitutes a criminal offence and hence  not within the  purview of  Consumer Protection Act.  

    In view of the  above, we find that the complainant herein is not a consumer within the ambit of  definition in Section 2 of the Consumer Protection  Act ,1986  and   that the alleged  deficiency  pertains to a criminal offence. Therefore, this complaint is hereby dismissed with liberty to the complainant to  approach the appropriate forum/court for redressal his grievance.

         Copy of this order be given Dasti.    

File be consigned to the record room.
