JUDGEMENT
The complainant Shri Ashok Kumar has filed a complaint under Section 12 of the Consumer Protection Act against the Executive Engineer, BSES (OP) for deficiency in services.
2. The facts in brief are that the complainant had a domestic electric connection (CA No. 100828563) in his name at 4980, East Old Seelampur Police Chowki, Delhi – 110 031. The complainant paid all bills well in time. It is stated that OP started the misuse of the said connection and the same was settled between the complainant and OP. The said meter was disconnected on 27.10.2015. The complainant applied for new domestic connection vide application no. 1009638774 and 1009638765 dated 21.05.2015. OP was to install a new meter and further to supply the electricity, but they did not pay any attention towards the requests of the complainant made from time to time. Thus, the complainant has prayed for installation of new electricity meter at 4980, East Old Seelampur Policce Chowki, Delhi–110031; compensation for Rs. 80,000/- for causing harassment, mental agony and pain alongwith litigation charges of Rs. 15,000/-

In reply, respondent has taken various pleas such as the complaint was not regular in making the payment of the bills of energy consumed by him and the connection has already been installed in the premises of the complainant; new connection was not installed as the consumer always refused to install outside the premises. Other facts have also been denied.
4. In the rejoinder, the complainant has controverted the pleas of the respondent and has re-asserted his pleas taken in the complaint.
5. In support of his case, the complainant has examined himself. He has deposed on affidavit. He has narrated the facts, which have been stated in the complaint.
In defence, OP has examined Shri U.N. Pandey, Commercial Officer BSES Yamuna Power Limited, Krishna Nagar (Div.). He has also deposed on affidavit and narrated the facts, which have been stated in the WS.
6. We have heard the Ld. Counsel for the parties and have perused the material placed on record. During the course of arguments, it has been stated on behalf of BSES that there was theft bill in respect of the premises, which was settled by the complainant and after settlement, consumer was assured for revision of his bill on pro-rata basis. The fact that matter has been settled and new meter has been installed, the prayer made in the complaint for installation of domestic connection stands satisfied. When his prayer with regard to installation of domestic connection stands satisfied and the meter was not installed due to theft bill, the question of compensation does not arise. Hence, the complaint deserves its dismissal and the same is dismissed. There is no order as to cost.
