Rajesh Sonthalia  Vs.  BSES

Present:-    Complainant in person.

        Heard. Complainant has filed the present complainant alleging that he has been enjoying Commercial Electricity Connection bearing CA No.100220267, CRN No.11110128712 which has been disconnected by the O.P and meter has been removed on 13.06.2013.  The meter in the name of the complainant and the same is “commercial connection”.   Question arises whether the complainant qualifies to be ‘consumer’?

2.     After the amendment of the Consumer Protection Act in the year 2003 if a person purchases goods or avails the services in connection with a business, he does not qualify to be a consumer unless it is for earning livelihood by way of self-employment exclusively.  No such averment has been made in the complaint, therefore, the complainant does not qualify to be a ‘consumer’ within the meaning of section 2 (1)(d) of Act.  Complaint is, therefore, dismissed.  Copy of the order be given to the complainant.   File be consigned to record room.
