  1. The complainant has come in present appeal against order dated 23.04.2015 passed by District Forum-East in CC No.753/14 vide which complaint was dismissed as not maintainable.

 

  1. Without going into the merits of the case, it is sufficient to mention that case pertains to bill of  theft of electricity. The same can be contested in special court under Electricity Act.

 

  1. Recently, the Hon’ble Supreme  Court in Uttar Pradesh Power Corporation Limited and Ors. Vs. Anis Ahmed, AIR 2013 SCC 2766 held that such case is not maintainable in Consumer  Court.

 

  1. Moreover, the impugned order notices the facts that complainant approached Grievance Cell of GNCTD and Hon’ble CM allowed rebate of Rs.19,738/- by waiver of penalty considering old age of complainant.

 

  1. In view of the same, the complaint no more survives.

 

  1. There is no infirmity in the impugned order.  The appeal is dismissed. 

 

  1. A copy of this order be sent to both the parties free of cost.  One copy be sent to the District Forum for information.

 

  1. File be consigned to Record Room.
