1.      This is an appeal under Section 15 of the Consumer Protection Act, 1986 (in short the ‘Act’)  wherein appellant/complainant has challenged the order dated 30.07.2015 passed by Ld. District Forum-X, CDRF, Qutub-II, New Delhi in CC no. 638/09 whereby the Ld. District Forum has dismissed the complaint for non appearance. The aforesaid order reads as under:   

                         Present: None for complainant.

                                      Counsel for the OP.

In fact nobody is appearing for complainant since 03.04.14 i.e. for      the last 5 dates of hearing. Complaint dismissed in default.

    File be consigned to record room.   

2.      No reply to the appeal is filed by respondent/OP. Averments made in the appeal are supported with affidavit of the appellant.

3.      We find no reason to disbelieve the same. It appears that due to death of his counsel the appellant/complainant could not appear before the District Forum. It is also come on record that appellant/complainant has already filed evidence before the District Forum.

4.      In these circumstances we accept this appeal and set aside aforesaid order and restore the complaint in original position.

          Let parties be appeared before the District Forum on 24.07.2018. The District Forum shall proceed with the matter in accordance with law. Copy of the order be sent to the District Forum for compliance.  

          File be consigned to record room.
