ORDER

 

Aggrieved by the order passed by the State Commission, the complainant as well as opposite party have filed separate revision petitions. Complainant had filed complaint No.238/2001 before the District Forum, which was allowed, against which opposite party-BSES filed appeal No.786/2006, whereas the complainant filed appeal No.356/2002. Both the appeals have been disposed of by separates orders. Appeal of the BSES has been disposed of vide order dated 20.9.2006 whereas the appeal filed by the complainant has been disposed of by order dated 10.1.2007.
     Aggrieved against those two orders the complainant as well as opposite party have filed separate revision petitions i.e. R.P. No.156/2007 and R.P. No.1621/2007. The former revision petition has been filed by the opposite party whereas the latter revision petition has been filed by the complainant.
Counsel for the parties are agreed that both the impugned orders be set aside and the case be remitted back to the State Commission to pass a common order by taking into consideration the submissions made by the parties.
     In view of the statement made by counsel for the parties, the impugned orders passed by the State Commission are set aside and the appeals are remitted back to the State Commission for a fresh decision in accordance with law by clubbing both the appeals. Parties through their counsel are directed to appear before the State Commission on 18.10.2011.
            Since it is an old case, we would request the State Commission to dispose of the appeals within a period of four months from the date of appeals.
