            The present complaint pertains to deficiency in service on part of BSES in supply of electricity.

            The complainant has been using three phase meter which was in name of his paternal uncle Mr. Shyam Babu Gupta.  This meter was being charged on industrial rate.  The complainant’s father Mr. C.B Gupta who had two separate meters i.e. one commercial and one domestic, expired on 05.02.2008.  The complainant father was the owner of a flour grinding shop in the premises after his father’s death the complainant alleges that aforementioned meters two were taken down by OP official on account of unpaid bills.

            The complainant states that he close down the flour grinding Shop and started using the meter in the name of Sh.Shyam Babu Gupta for domestic purposes.  He thereafter applied for change of meter and is new domestic connection.  He alleges the OP company took Rs.23,000/- to adjust the bill and change the meter.  The complainant felt that the meter was running very fast and he got it checked.  The BSES officials on 22.06.2011 inspected the meter and the premises and told him that the meter is running properly.

Complainant requested for the new connection.  The Ops asked for documents.  Ops further asked for the arrear of the bill sh. C.B Gupta.  The three phase industrial meter in the name of Mr. Shyam Babu Gupta was transfer to the complainant’s name after filing of no objection certificate by Mr. Shyam Babu Gupta.  The complainant alleges that he is being forced to use the industrial meter for home consumption which is on one hand showing 40% to 50% increase reading and on a other hand the charges are almost double the domestic meter.  Complainant prays for a new domestic connection and for the correction of the bills which were raised on three phase meter.  Complainant annexed bills and various application made to OP company.

            OP in its version has stated that the complainant does not pertain to Consumer Courts.  OP also admits that the complainant has applied for six new electricity connections but the application was rejected due to non-payment of outstanding dues on the said premises in the name of Late sh. C.B Gupta. 

OP also states that Rs.23,000/- was paid for revise and settle bill up to 11.05.2011.  As the connection was use for domestic as well as for ration shop, the units were charged as per industrial rate.

            OP in Para no.8 admits that the three phase industrial connection in the name of Sh. Shyam Babu Gupta was transferred in the complainant name.  Ops states that a new connection can only be allowed if the outstanding dues on the premises are paid by a legal heirs of the deceased Mr. C.B Gupta.

            The complainant has filed a rejoinder stating that his ration shop was closed on 14.03.2011 by order of Food and Civil Supplies, Govt. of Delhi.   Complainant is also alleges that the meters of late Sh.C.B Gupta is being used by Mr.Rajesh Gupta and as such the electricity bills had to paid by his brother.

            We have gone through the documents and pleadings.  Documents placed on record.  The record shows that the complainant is using industrial meter which was transfer to him by his paternal uncle Sh. Shyam Babu Gupta. The complainant seeks domestic connection.  Ops are not willing to provide domestic connection as there are dues pending on the premises.  The complainant is also praying for inspection and connection of meter reading.
