The case of the complainant is that on 26.05.13 he deposited a sum of Rs.1450/- with DESU and obtained a new connection bearing K.No.711/137254. Thereafter the complainant has been receiving bills and regularly making the payment of the bills. However, in June 2002 complainant received a wrong bill for a sum of Rs.57,219/- and K.No. mentioned on the bill was wrong and pertaining to K.No.711/137262. It is stated that there is deficiency in service on the part of OP. The bill was not rectified despite complainant met officer of OP number of times hence this complaint has been filed.
OP in reply took the plea that in fact the correct number was K.No.711-137262 and it was matter of double billing and actual bill will be issued to the parties after making adjustment. Thereafter an affidavit was filed by an official of OP wherein it is stated that the bills were issued against wrong K.No.NH011-1372542 DL whereas the correct K.No. is NH711-137262 DL and revised bill for Rs.1948.20 has been raised after adjusting all the payment made by the complainant.
In fact the complainant has paid revised bill as is clear from the order sheet dated 13.04.04. Thereafter the matter dragged on. Complainant moved an application no. u/s 195 read with section 340 of CPC.
We have carefully perused the record and gone through the written submissions of the parties.
It is a fact that wrong bill was issued to the complainant with a threat of disconnection. But it is also admitted fact that the mistake was rectified and revised bill for Rs.1948.20 was raised and that bill has been paid. Taking into consideration the totality of the matter, the interest of justice will suffice if complainant is paid a compensation of Rs.5,000/- as well as litigation expenses of Rs.5,000/-. If the amount is not paid within one month it will carry an interest @ 9% p.a. till the amount is paid.
Let the order be complied within one month of the receipt thereof. The complaint stands disposed of accordingly.
Copy of order be sent to the parties, free of cost, and thereafter file be consigned to record room.
