The complainant has filed the present complaint against the O.P under section 12 of Consumer Protection Act, 1986. The facts as alleged in the complaint are that he has purchased one printer of Brother Printer Model No. DCPL2520D from Shrichand Computer Pvt. Ltd. on 30.05.2017 for sum of Rs. 10,650/-. However within three months printer stated giving problem of maser unit which on complaint was rectified but after some time the same problem re-occurred and complainant was told to purchase new laser unit worth Rs. 3000/-. The complainant contended that since the printer was under warranty so the OP was responsible to rectify the defect . Since OP did not do the needful so he approached this Forum for redressal of his grievances.
Notice of complaint was sent to OP for 09.07.2018
On 09.07.2018 the complainant appeared and stated that printer involved in the present complaint has been replaced by the OP-I 07.06.2018. He further submitted that though the complaint stand satisfied but he should be compensated for inconvenience and litigation expenses.
We have heard the complainant in person and perused the record.
The present complaint was instituted in this Fora on 07.05.2018 and admittedly the printer was replaced by OP on 07.06.2018, which indicates that within a spell of one month the OP promptly replaced the printer to the satisfaction of the complainant. Now question arises as to what amount should be awarded to the complainant for the inconvenience and litigation expenses . The record indicates that complainant has not suffered much harassment and inconvenience at the hands to the OP, neveretheless he had to file the present complaint for redressal of his grievances and attend Fora on two dates. We are of the opinion that in the facts and circumstances stated above it would meet the ends of justice if complainant is awarded Rs. 15,00/- towards inconvenience and litigation expenses
