First complainant is the daughter of 2nd complainant, that the first complainant had passed her B.Sc Nursing Course and was waiting for an admission to M.Sc Nursing course, that opposite parties are running an institution by name “Jubilee Education Foundation and Charitable Society’’ having Reg.No.Q 44/08, that they used to arrange admission to M.Sc Nursing, that the complainants approached the opposite

parties and for arranging admission for M.Sc Nursing in Nagarathnama College of Nursing opposite parties received Rs.10,000/- on 09/04/09 from the complainants as

advance and given a provisional Admission Letter, that they have also received the photos and copies of certificates of first complainant but admission not yet received, that thereafter complainants demanded the advance several times but the opposite parties have not tuned up, that there is deficiency in service on their part and hence this complaint praying to direct the opposite parties to return the above Rs.10,000/- with 18% interest and also claiming Rs.10,000/- as compensation and also costs of the proceedings.

 

On receipt of notice opposite parties filed vakalath on 10/11/2011 but not turned up thereafter. Hence they are declared exparte.

 

Second complainant filed affidavit for himself and on behalf of his daughter first complainant. Complaint stands proved through the affidavit and Ext.P1.

 

In the result, the complaint is allowed directing the opposite parties to return Rs.10,000/- received by them on 09/04/2009 from the complainants with interest at the rate of 12% from that date and also directing the opposite parties to return the photos and copies of certificates of first complainant received by them, Rs.1000/- towards compensation and Rs.500/- towards cost of the proceedings within 30 days from the date of this order.
