                                                  JUDGMENT

MR. JUSTICE AKHTER HUSAIN KHAN, PRESIDENT (ORAL)

None appeared for applicant. Perused application moved on behalf of Union of India.

Present application has been moved in appeal No.1720/11 Union of India Vs Brijrani Sharma with prayer to refund amount of Rs.25,000.00 deposited in said appeal by appellant under Section 15 of the Consumer Protection Act with interest.

Perusal of records of said appeal shows that said appeal has been allowed and the impugned judgment and order dated 02.07.2011 passed in complaint case No.12/11 by District Consumer Forum has been set aside. The case has been remanded back to Forum for disposal in accordance with law.

In view of above judgment passed by State Commission in said appeal, the amount deposited under Section 15 of the Consumer Protection Act should be refunded to the appellant.

In view of above application is allowed. The amount deposited under Section 15 of the Consumer Protection Act shall be refunded to applicant in accordance with law.
