ORDER

 Per Shri S.R. Khanzode, Hon’ble Presiding Judicial Member

 

          This is an application for restoration of Appeal No.1271/2009, Mr.Prashant Bajirao Kalantre V/s. Bright Steel Co-op. Hsg. Society Ltd, which stood dismissed for default on 07/07/2010.  On that date, both Lawyer and appellant were absent and it was also noticed that they failed to comply the previous directions to issue notice to the respondents also.  Thus, in short they also failed to effectively prosecute the appeal. 

We heard Mr.A.B. Jadhav, Advocate for the applicant/appellant.  The only ground that is presented for non-appearance of appellant as well as his Counsel is that the Advocate was pre-occupied in other Court.  No other ground is mentioned and this ground is totally discarded as per Regulation No.11(8) framed under the Consumer Protection Act, 1986.  In the circumstances, we find no merit in the application.  Hence, we pass the following order :-

          -: ORDER :-

1.       Application stands dismissed in limine.

2.       No order as to costs.

3.       Copies of the order be furnished to the parties.
