An undated complaint was presented by the complainant in person on 13.03.2024. The same was registered as CC No. 43/2024 and put up for consideration on the maintainability of the present complaint today on 14.03.2024.
Heard. The complainant mentioned that he had purchased “Sega Company” original shoes from the OP for Rs. 400/- on 08.03.2024. After 08-10 days from purchase the said shoes the complainant went to the above shopkeeper and told that you gave me duplicate shoes instead of Sega company Shoes which start stinking as soon as you wear them. The complainant has not produced any authentic bill for purchase of the said shoes.
It has been observed that the complainant has used letter head of a society viz. “JAN KALYAN WELFARE SOCIETY, VPO Rasiwas, District Charkhi Dadri.” But no resolution in regard to filing the present complaint on the letter head of the society was made available to the Commission. Further the complainant, viz. Shri Baldev Singh had purchased shoes for his personal use. He has failed to convence, this Commission about what harm caused to the society. We are of the view that an individual should not use the letter head of the society to fulfil his own interest.
The complainant has failed to place on record any cogent or authentic document/ bill for purchase of the shoes and guarantee card etc. in support of his complaint. The onus lies on the complainant to satisfy this Commission with evidences for issuing notice to the OP which is missing in the present complaint.
Hence, prima-facie, we opine that it is not a fit case for summoning of OP by issuing notice by this Commission. Therefore, the complaint of complainant being not maintainable in the present form, deserves dismissal. Hence, the same is hereby dismissed, with reiteration of earlier directions to the complainant to refrain himself from filing such unfounded complaints which may lead to imposing of penalty on the complainant for wasting precious time of this Commission.
It has been observed from the records that the complainant viz. Shri Baldev Singh has filed 4th such unfounded complaint in February and March, 2024 by using Letter Head of “JAN KALYAN WELFARE SOCIETY” with ulterior motive to serve his own interest. The present complaint has been filed despite directions of this Commission vide order dated 12.03.2024 to refrain himself from filing such unfounded complaints, which may lead to imposing penalty for wasting time of this Commission. He has become habitual to file such complaints by using Letter Head of the Society. He is warned not to file such complaints without any evidence. In the circumstances, this Commission may impose penalty upon the complainant for repeatedly filing such fictitious complaints. However, we deem it appropriate not to impose any penalty this time and warn him to desist from filing such complaints without adequate documents/evidences in support of his complaint.
Copy of the order be supplied to complainant free of cost. File be consigned to the record-room.
