Shri S.L. Behera, President:-   The brief facts of the complaint case is that, the complainant’s deceased husband Bhola Majhi was working as a trackman in Indian Railways and he retired from his service on 04.02.2002 but unfortunately he died on 19.01.2013.  Before his death the pension amount was drawing through O.P.No.1 which should be receiving by the complainant, after the death her said husband but the complainant is not getting any pension amount about which she requested several times to the O.P.No.1 as well as O.P.No.2 but no result has come out, hence this case.

            On receiving notices the O.P.No.1 filed his written version through his counsel and submitted that they have forwarded the pension papers along with Treasury Challan of Rs.68,618/- only towards pension and other benefits to it Centralize Pension Processing Centre ,Bhubaneswar Circle on dtd. 08.12.2014 for approval and payment from where the O.P.No.1 was advised to reverse the Treasury Challan and credit it to IBTS for further necessary action and as per the advice the O.P.No.1 contacted with District Treasury Office, Jharsuguda for correction of account and to credit the amount to Railway Suspense Account  No-8658. The O.P.No.2 contacted and received letter from the South Eastern Railway Authority dtd. 23.06.2016 with revised PPA and is sincerely trying to release the pensionary benefits along with arrear pension and denying all the allegations.

            The O.P.No.2 appears through his advocate and submitted that the complainant was working at Brajrajnagar which comes under South Eastern Railway, Bilaspur instead of which the complainant has made party to the O.P.No.2.  The south East Central Railways, Bilapur is the necessary party and the O.P.No.2 should be deleted from the present case. 

            Heard from the parties and gone through the case record. The complainant‘s deceased husband was working in Indian Railways at Brajrajnagar which comes under South East Central Railway, Bilaspur but the complainant had made party to the East Coast Railway,Bhubaneswar ( O.P.No.2).  After the death of her deceased husband while the complainant was in approach to the O.P.No.1 and the concerned authorities of Railway the O.P.No.1 taken initiatives to release the pensionary benefits along with arrear pension amount and finally credited the arrear pension amounts in the saving bank account of the complainant bearing account No. 33717689649 from December,2013 to August ,2016 ( Original statement of accounts filed by the O.P.No.1) .

            As per the above circumstances, complainant received all her arrear pension amounts through the O.P.No.1 and we do not found any deficiency in services on the part of O.Ps. Hence, the present case is hereby dismissed with no costs. 

                        Accordingly the case is disposed of.

Order pronounced in the open court today the 26th day of September’ 2016 and copy of this order shall be supplied to the parties as per rule.
