Deficiency in insurance service is the grievance of the petitioner .

            The facts  relevant as per complaint petition in short are  that the petitioner is a registered owner of a TVS Apache ,RTR 200 Motor Cycle  bearing Regd. No. OD-34-C-1937  which   is insured with O.P.no.1  bearing policy No. 0921003117P111816672  covering the period of Insurance from 07.01.2018 to 06.01.2019 .During the continuance of policy the motor cycle  which was kept inside the residential campus of the petitioner with proper luck  was stolen by some unknown culprits  on 27-28.8.2018  mid night . Thereafter the matter of  theft was informed to the I.I.C, Korei  P.S  vide P.S Case No. 173/18 U/S 457, 380 I.P.C corresponding to C.T.case No.918/18 of J.M.F.C,Jajpur Road registered and investigation was taken up . After completion of investigation  the I.O submitted FRT as true but no clue . The petitioner also intimated the matter of theft of motor cycle to the O.P but the O.P did not take any action .  The petitioner also went to the office of  O.P and repeatedly approached him to settle the theft claim . But the O.P did not initiate any theft claim .  Finding no other alternative  the petitioner sent  a letter to the head office on 25.04.19 but the O.P did not take any action  for settlement of the claim . By this way the O.P is avoiding to initiate or to settle  the genuine O.D  claim of the petitioner and adopting unfair trade practice which  is coming within the purview of deficiency in service . Finding no other way the petitioner knocked the door of this Fora  with the prayer to direct the O.P to settle the theft claim  of his motor cycle  and award compensation of Rs.10,000/- for mental agony.

 The  notice  though duly served on the O.P but the O.P  did not choose to file any objection or written version against  the complaint petition. Accordingly the O.P  was   set  exparte on 02.11.19 .

                On the date of hearing we heard the argument from the learned advocate of the petitioner . After perusal of the record  and documents  in details it is undisputed  fact that the petitioner is a registered owner of the alleged vehicle . The petitioner  vehicle was also duly insured with the O.P .  On the other hand  the O.Ps has  neither appeared nor filed  any objection or written version against the complaint petition.  Accordingly there is no scope before this Fora to dis-believe the petitioner than to accepting  the uncontroverted statement  made by the complainant  in the complaint petition  as per observation of Hon’ble State Commission or National Commission  reported in 2003-CLT-Vol-96-p-15-para-4( C.C.Case No.37/2002-Odisha , 2013(11) CPR-507 –N.C respectively.

Hence this Order

             In the result the dispute is allowed against the O.P as exparte . The O.P is directed to settle the claim of the petitioner within one month after receipt of this order as well as  the O.P is  liable to pay Rs.5,000/- as compensation  to the petitioner . The petitioner can recover the same as per  proper procedure of law  in case the order is not complied within the stipulated period . No cost.
