The case of the Complainant in short is that she is a pension holder and she is getting her pension through the Opposite Parties vide her pass book No. 31629282662 . But she was not getting pension from O.P .Bank from the month of May 2011 . Hence , she has filed this Complaint through Counseling center claiming compensation of Rs. 10,000/- from the Opposite Parties .

 

The case of the Opposite parties as per their version is that the Complainant was getting his family pension from the District Treasury , Phulbani and subsequently from the O.P Bank .So, necessary papers were sent by the Treasury to the Central Pension Processing Cell Rasulgargh, Bhubaneswar and was duly processed . Accordingly on 27-12-2013 the alleged claim amount with up to-date interest i.e Rs.11,410/- was credited in the account of the Complainant instead of claim amount of Rs. 10,500/- Hence, the Opposite Party has not committed any deficiency in service .

 

We have heard the learned counsel of the Opposite Parties in absence of the Complainant . As the Complainant has received her pension in the mean time there is no merit in her complaint petition . There is also no suitable evidence regarding any negligence of the Opposite parties in the matter . The Complainant is also not a Consumer as per provision of the C.P Act . Hence , the Complaint is dismissed as not maintainable in the eye of law .
