Shri S. L. Behera, President : - The brief facts of the complainant’s case is that, he has taken a loan from the O.P for refinancing a truck bearing Regn. No. OR 23D 2274 on dtd. 23.04.2015 which the complainant was liable to pay the loan amount of Rs.6,00,000/- only with interest in installments up to 05.04.2019. The complainant has paid more than Rs.2,00,000/- only up to October’2016. The complainant is interested to clear his dues but the O.P is not furnishing any statement of account and the O.P refused to any amount from the complainant, hence this case.
The O.P. appeared through his counsel after being noticed and submitted his written version wherein it has been stated that the complainant is a defaulter in making payments of installments. The O.P submitted that, the complainant has taken loan to purchase a vehicle and availed loan of Rs. 6,00,000/- only by executing loan agreement bearing No. JHARSU050220004 DTD. 23.04.2015 and refinance a truck regn. No. OR 23D 2274. The O.P. further submitted that the complainant has outstanding dues of Rs.8,13,015/- only up to 10.02.2017 and filed a statement of accounts. There is no any deficiency in service and prayed for dismissal of the case.
Heard and perused the case record along with materials available. The complainant was financed a truck bearing Regn. No.OR 23D 2274 by the O.P for an amount of Rs.6,00,000/- only which was to be refunded in monthly installments. As per the statement of accounts issued by O.P. dtd. 10.02.2017 the complainant has installment overdue of Rs. 8,13,015/- only as on dtd. 19.02.2017 in total.
After executing the loan agreement there must a copy of the said agreement with the complainant. On the other hand O.P is also entitled to get his dues amounts from the complainant, hence in the present circumstance is hereby partly allowed with directions to the O.P to supply a copy of loan agreement to the complainant along with afresh statement of accounts and receive the outstanding dues amount from the complainant.
Accordingly the case is disposed of.
Order pronounced in the open court today the 30th day of October’ 2017. Free copy of this order shall be supplied to the parties as per rule.
