           This is  a  petition U/s. 35 of C.P.Act, 2019.

2.       The  case  of the  complainant  is that he   is  a resident   of  Bhairabi Sahi ,Ward No.6,Talcher  of Angul District  and the opp.parties  are  the   insurance  company, running  its business in other places  including  Angul district to  earn profit. In the  year 2018  the  complainant  had  purchased   a second hand  truck  bearing  Regd. No. OR 19 F 1886  by  getting  finance  from  Shiram Finance Co.Ltd,  Talcher  to  earn  his livelihood. The  aforesaid  truck was having  a valid  insurance  policy bearing No. 10003/31/21/172437 .The  complainant  was  keeping the  aforesaid  truck  near   Bibhuti Garage at by-pass  chawak since  December, 2019 .He used  to  look after the   said truck  by  keeping  the same in the  said  place. On 25.12.2020 the   complainant  felt  uncomfortable  and   for  better treatment he  went to the  Institute of  Medical Science i.e Sum Hospital,Bhubaneswar. On 26/12/2020  when  the  complainant  returned  to Talcher  after  his  treatment  he found the  truck  missing  from  spot where it  was kept. The  complainant  with the  help of  his  friends  searched   for  the  vehicle and  found the same  in the  scarp shop  of   Rakesh Jayswal,Bikar Samal in a  half  cutting  position on 31.12.2020. He lodged  a written  report in the  nearest   police station  and  sent  information to opp.party No.1.The IIC registered  P.S.Case  No. 0462 dtd. 31.12.2000 and  directed   S.I Manohara Patra  for   investigation.  On the  same  day the  complainant approached the  opp.party No.1  in  his  office and  requested  him to   lodge  a  total damaged  claim. He  also  submitted all the  documents  required by the opp.party No.1. After receipt of  all the  required  documents  such as registration certificate, copy of insurance policy , permit , FIR  copy etc.  The opp. party No.1  remained  silent. As the opp.party No.1 did not  release the total damaged claim inspite of repeated  request of the  complainant, he  lodged  this  complaint before  this  Commission. The  complainant  unable to  pay the  monthly    instalments   to the  finance  company and  under   serious  mental agony and  harassment . Hence this  case.

3.       Notices  were  issued  to  both the opp. parties  through  Regd. post with A.D on 19.02.2021. From the A.D of  opp. party No.1  it  transpires  that  he  has received  the  notice  issued by this  Commission  on 25.02.2021. The A.D  in respect of opp.party No.2  is  not  back. Admittedly  notice has been issued to the opp. party No.2  through Regd. Post with  A.D in correct  address  on 19.02.2021  , till  now the A.D is  not  back. Hence the  notice issued  against opp. party No.2   is  deemed  to be sufficient  in view of  Section -27 of General Clauses  Act. Inspite of  notice  non of the opp. parties  turned up  to  file their  show cause and  contest the  case. Hence they are  set exparte  on 12.09.2022.

4.       The  complaint petition filed by the  complainant  before this  Commission is  supported with affidavit. In addition  to it  the complainant  has also filed  an affidavit  evidence  during   hearing  of the  case. In his  complaint the complainant  has   mentioned  that  that he has purchased  a second hand  truck  bearing Regd. No. OR 19 F 1886  in the  year 2018  by  availing  loan  from  the  Shriram Finance Co. Ltd, Talcher branch on  re-finance scheme. He has  purchased the  truck to  pursue  his   business  to earn  his livelihood. The  said  vehicle  was insured  under opp. parties  bearing  insurance policy   No. 10003/31/21/172437 .The  complainant  use  to keep  his  truck   near Bibhuti Garage at by-pass Chawak,Talcher. On 25.12.2020 the  complainant  felt  uncomfortable  and  went to  Sum Hospital Bhubaneswar. It   is  also mentioned in the  complaint petition  that  on 26.12.2020  he  returned  from Bhubaneswar and  found  the  truck  missing . It  further  transpires  from the  complaint petition  that  with the  help of  his  friends   he  searched  the   vehicle  and  found  it  at  scrap  shop of  Rakesh Jayswal  in  half  cutting  position  and  informed  the mater to IIC,Talcher who registered FIR No. 0642 on the same  day and   investigation was  started. Admittedly  the  vehicle has been    subjected   to  theft.  The  insurance  is  for the  period 31.07.2020  to  mid night of  30.07.2021. So the  vehicle  was  duly  covered  with  insurance  when it has been  subjected to  theft. From the   photocopy of the  medical   paper it  also  appears that   on 26.12.2020  the  complainant  was  treated  at Sum Hospital ,Bhubaneswar. The  vehicle  was also  having  a goods  permit, which was  valid  from 13.06.2018  to  12.06.2023.

5.       The  allegation of the  complainant is  supported by  affidavit  evidence  filed   him  during  hearing.  However, the  complainant  failed  to file the  copy of  charge-sheet , so there  is  no material  before this Commission  that the  vehicle of the  complainant  has been  subjected to  theft. Unless  the  complainant  prove his  case that   his  vehicle is  subjected to  theft  , it  will not come  under the  coverage of  insurance. So  the  complainant  failed  to prove that the  truck owned  by  him has been  subjected  to  theft. This  is  a pre-mature  case.

6.       Hence ordered :-

: O R D E R :

          The  case  be  and  same is dismissed    exparte against the opp.parties. The  case is pre-matured one. The  complainant is  free  to  approach  the  competent authority  after charge sheet is filed   or any  new cause of  action.
