ORDER

 

                   Case of complainant, in brief is that he is having saving account No.4674001500032761 in the branch of op no.1 i.e. Punjab National Bank, Rori Bazar which is a lead Bank. He has also availed ATM card facility for which the bank deducts an amount of Rs.112/- per year from his account but when he is in need of money, then ATM does not work. Although, the ATMs of the ops are installed at every place but the same do not work in lack of maintenance and the complainant is forced to go to ATM installed in their branch or to the ATM of other banks due to which inconvenience is caused to him. The complainant visited the Bank and gave written complaint to the Branch Manager in this regard but he instead of reading his complaint misbehaved with him. Then he lodged his complaint regarding misbehave done by Branch Manager on the website vide CRM Service No.5000108830 which was also closed without any investigation. Hence, this complaint.

2.                Upon notice, opposite parties appeared and replied that complainant used to withdraw the amounts after using the facility of their ATM for which the bank charges Rs.112/- per year. It is wrong that ATMs of the ops remain faulted. The complainant has not mentioned that on which date he visited ATM of ops and when he faced the above said problem rather they are provided best services. Remaining contents of the complaint have also been denied.   

3.                The complainant has produced his affidavit Ex.C1, copy of application Ex.C2, copy of receipt of complaint made on website, withdrawal slips of ATMs Ex.C4 and Ex.C5.  On the other hand, ops placed on file affidavit of Sh. P.D. Garg, Chief Manager Ex.R1 and statement of account of complainant (Account ledger inquiry) Ex.R2.

4.                We have heard complainant as well as learned counsel for ops and have gone through the case file carefully. Written argument also filed by complainant which have been perused.

5.                The complainant has placed on file only two ATM withdrawal receipts on file. The withdrawal dated 29.7.2016 which the complainant claims to be from Axis Bank, Barnala road contained in ATM withdrawal receipt Ex.C4 is not sufficient to prove the allegations of the complainant. The another ATM withdrawal receipt Ex.C5 is of SBI, Sadar Bazar Sirsa. On the other hand, ops have placed on file account ledger inquiry of complainant’s account as Ex.R2 (containing thirteen pages) from which it is evident that complainant is withdrawing the amounts since 11.2.2010 through their ATMs and there are so many entries in this regard in that document Ex.R2. In these circumstances, we do not find any merit in the present complaint and same is hereby dismissed but with no order as to costs. A copy of this order be supplied to the parties as per rules. File be consigned to record room after due compliance.
