Shri S. L. Behera, President : - The brief facts of the complainant’s case is that the complainant is a saving bank account holder of O.P Punjab National Bank, Brajrajnagar Branch having account No. 4019000400026198 issued on dtd. 05.07.2015 and the same is operating by the complainant. Due to alleged freez of the said S/B Account by the O.P Bank without the consent of the complainant causing disruption of the bank transaction the complainant could not operate his account since dtd. 12.05.2015. After enquiry from the O.P Bank the complainant could able to know that his wife Sahnaj Khatun having
an account in the O.P bank was an introducer of one Sheela Ghasi at the opening of the new account in the name of Sheela Ghasi. As because the complaint’s wife was an introducer to the account of Sheela Ghasi due to dispute on the account of Sheela Ghasi Bank account of his wife and the Bank account of the complainant were freez by the Bank. The O.P Bank contested the case and in its written version do not dispute with the S/B account of the complainant and submitted that on the verbal inquiry of the Brajrajnagar Police officials concerning the account of Sheela Ghasi along with account of the complainant with his wife were freezen temporarily till completion of inquiry and to protect the interest of the Bank as well as the account holder from any unauthorized transaction in the said S/B account of the Sheela Ghasi and the complainant. It is further submitted that as per the order of the Hon’ble Forum S/B Account of the complainant has been released and the account is in operation.
The complaint petition was filed on dt.22.08.2015 and after its admission, this Forum has passed an interim order on dtd. 03.09.2015, directing the O.P. Bank to resume the operation of S/B Account of the complainant and the operation of the account is continue till date. The explanation placed by O.P.Bank relating to freezon of the account appears to be probable as and when police inquiry concerning to a particular Bank account was continuing, obviously the particular disputed account can be freezed by the Bank. But the Bank is not empower to freez the account of introducer of the disputed account as the role of introducer is only to identified the person for opening a new account as because the introducer is having his/ her account in the said Bank.
However when the complainant has not sustained any loss due to the freezon of the account, we think that the O.P. Bank shall not saddled with deficiency in service in respect to the complainant. Accordingly the case is dismiss and disposed of with a direction to the O.P Bank not to act this type of fault in future.
Order pronounced in the open court today the 29th day of April’ 2016 and copy of this order shall be supplied to the parties as per rule.
