The appeal is taken up for final hearing at 3.00 p.m. None is present for the appellant. Adv.H.A.Patankar holding for Adv.V.N.Upadhye for the respondent is present. He submitted that appellant and his advocate have not appeared before this Commission, hence appeal be dismissed. The perusal of the earlier proceedings show that the appeal was admitted on 11/04/2008. Thereafter Adv. Ganore appeared for the appellant on 08/12/2008 only. None appeared for the appellant after the said date. Thus the appeal came be adjourned on several dates. None was present for the appellant on 29/06/2009, 04/01/2010, 15/06/2010, 05/10/2010, 25/08/2011, 15/11/2011, 18/04/2012 and 19/07/2012. Even last chance was granted for final hearing to the appellant. Today also none is present for the appellant. Hence, we are satisfied that appellant is not interested in pursing the appeal. Appeal is therefore dismissed in default.
