The gist of the complaint is as follows:-

The Complainant had purchased two units of the Deepasthambham Project of the Opposite Parties, paying Rs.20,000/- on 21.05.2007 and on 30.04.2006. The Opposite Parties assured the Complainant that the invested money would double by 100 weeks. Opposite Parties assured to give a share of profit gained from the lottery business of Opposite Party to refund the invested money at any time after the maturity of the deposit.

2. The Opposite Parties have not paid any amount to this Complainant inspite of the repeated demands made by the Complainant. This is deficiency in service on the side of the Opposite Parties. Hence the Complainant prays for an order directing the Opposite Parties to return the invested money with 18% interest along with the share of profit.

3. The Opposite Parties were declared exparte. The Complainant filed proof affidavit and documents were marked as Exts. A1 and A2 on the side of the Complainant.

4. The matter to be decided are:-

1. Whether there is any deficiency in service on the side of the Opposite Parties?

2. Whether the Complainant is entitled for any relief.

5. Point No.1:- Exts.A1 and A2 shows deposit of Rs.20,000/- by the Complainant in the Deepasthambham Project of Opposite Parties. There is no evidence from the Opposite Parties that they have returned the money. There is also no evidence that the Opposite Parties have assured about doubling the investment or giving any profit share. However not returning the invested money even after repeated demand is deficiency in service.

6. Point No.2:- The Complainant is entitled for return of the amount with reasonable interest.

Hence, the complaint is partly allowed and the Opposite Parties are directed to return the amount of Rs.20,000/- (Rupees Twenty thousand only) along with 12% interest from the date of deposit till payment. The Opposite Parties are also directed to pay Rs.500/- (Rupees Five hundred only) as cost of the petition. This order is to be complied with within 30 days of the receipt of this order.
