1.       None present for appellant.  Adv.Smt.Madhubala Gangwal present for respondent No.1 & 2 submitted that appellant is not present since last so many dates. Hence appeal may be dismissed in default.

2.       Perusal of earlier order sheet shows that none appeared for appellant on 10.10.2011, 5.1.2012, 7.3.2012, 27.4.2012, 12.7.2012 and 5.9.2012.  No steps are also taken since long by the appellant for issuing notice to respondent No.3 though directions were given from time to time.  Therefore  we are satisfied that appellant is not interested in pursuing the appeal.  Appeal is thus dismissed in default.
