ORDER

Complainant/petitioner had obtained a insurance policy on 15.9.2005 from the respondent with single time premium of Rs.4 lakh with annuity return value of Rs.24,040/-.  She had been receiving cheques for the said amount from LIC, Zonal Office, Kolkata regularly since October 2006 payable at par at all the branches of State Bank of India (SBI) till October 2007.  Till then, there was no problem.  During August 2008, she received a cheque worth Rs.24,040/- from LIC, East Central Zonal Office, Patna payable at par at all branches of Axis Bank Ltd.  But there was no branch of Axis Bank at Kuchinda, where the petitioner resides and she was compelled to deposit the said cheque in the SBI, Kuchinda and the SBI deducted Rs.230/- from the amount of the cheque towards collection charges. 

          Petitioner, being aggrieved, filed the complaint before the District Forum.  On being served, respondents put in appearance and agreed to pay the collection charges.  District Forum allowed the complaint and directed the respondents to pay to the complainant Rs.5,000/- as compensation for mental agony and harassment and deficiency in service, return arrears of collection charges, if any, and to pay Rs.1,000/- towards litigation expenses within one month.  The respondent was directed to include the collection or any other charges to facilitate the complainant to draw the actual and real annuity return value and to refrain from such unfair trade practice.

          Dissatisfied with the order passed by the District Forum, petitioner filed appeal before the State Commission which has been dismissed by the impugned order.

          We agree with the view taken by the State Commission.  Whatever relief the petitioner had asked for has already been given to her.  No further relief can be granted. 

Shri Purnananda Sahu, who is the son of the petitioner, submits that the order passed by the District Forum is not being implemented.  If that be so, petitioner is advised to file Execution Application before the District Forum.  Dismissed.
