                                                The case of the Complainant in short is that he is a policy holder under the O.P vide policy No.590305583. During his service period Rs. 67/- was deducted from his pay towards the premium of the said policy but the same amount was not deposited from the year 2001 to 2004 for which the same amount was taken by the O.P along with his loan amount of Rs. 2250/- with interest. So, he lodged complaint in the branch office of Phulbani and subsequently filed a complaint before the Consumer Counseling Center, Phulbani.  The O.P deposited Rs. 2948/- in his account towards the premium but no interest was granted in his favor. Subsequently he came to know that the O.P has deposited Rs. 3029/- in his account towards interest on 28-06-2016. He has filed this complaint against the O.P for compensation of Rs. 15,000/- for his mental agony and towards cost of litigation.

                                                The case of the O.P as per his version is that after getting notice from the Consumer Counseling   Center , Phulbani they got information from the policy holder that monthly premium of Rs. 67/- has been deducted from his salary and remitted with wrong policy no 570305583 by his paying authority during the period from 01/2001 to 8/2004 . The premium has also deducted from his policy loan sanctioned on 09-09-2004 as gap premium at L.I.C of India, Bhubaneswar Branch -11. Accordingly they have written a mail to Bhubaneswar Branch on 02-04-2016 on premium position. On 05-04-2016 they have received the reply from Bhubaneswar Branch that the premium from 04/2001 to 8/2004 has been received and adjusted as per policy ledger. So on 30-05-2016 they paid Rs. 2948/- vide their transaction No. 3889 to the Complainant’s NEFT account towards premium. They forwarded the letter of the Complainant on 10-06-2016 to the Divisional Office for sanction of interest and after confirmation  Rs. 3029/- was paid on 28-06-2016 towards interest for 11 years and 5 months on simple interest as per office rule, for which the complaint be closed.

                                                During course of hearing we have heard both the parties. We have gone through the complaint petition, the version of the O.P and the documents filed by both the parties. It is seen from the version of the O.P that the Complainant had received Rs. 2948/- towards the premium from 2001 to 2004 and Rs. 3029/- on 28-06-2016 towards interest for 11 years 5 months. It is pointed out by the O.P that the interest is simple in nature as per office rule. The Complainant has not mentioned in his complaint regarding his service and he has also not made a party to his paying authority who deducted the premium from his salary and remitted with wrong policy number. So, in the above situation, in our view the O.P has not committed any deficiency in service on their part. Hence, the complaint filed by the Complainant stands dismissed as devoid of merit.
