O R D E R
The case of the Complainant in brief is that he was a Life Insurance Policy holder under the O.P bearing No.57605606 dated 28-02-2001. The same policy was matured on 29-10-2016. So, he prayed the O.P for payment of the matured amount after submitting all documents but the O.P failed to pay the matured amount to the Complainant in spite of his repeated request and personally visit .So, this complaint was filed by him for payment of maturity amount along with interest . He is also claiming compensation of Rs. 10,000/- towards his mental agony and Rs. 2,000/- towards cost of litigation.
The case of the O.P as per his version is that the Complainant did not submit application for maturity claim in time. The policy holder submitted his claim application in the office of the O.P on 28-10-2016. The matter was processing by the O.P with corresponding to the Division Office. In the mean while the Complainant filed this complaint petition. However the maturity amount to the tune of Rs. 22425.00 credited to the policy holder Saving Account No. 001101042141 of ICICI Bank Mumbai- Andheri Link Road Branch on 21-02-2017 vide TR No.24878 through NEFT. The delay was caused due to compliance by the policy holder for which there is no scope for payment of interest, compensation and cost in the instant case.
-2-
We have gone through the complaint petition, the version of the O.P and the documents filed by both the parties in support of their case. We have also heard the learned counsel appearing for both the parties. It is seen from the Memo submitted by the Advocate of the Complainant that he has received Rs. 22,450/- on 22-02-2017 in his account through NEFT from the O.P.
In the above circumstances there is no deficiency in service on the part of the O.P. As the Complainant had already received the maturity amount of his policy since 22-02-2017, the Complaint petition has no merit and dismissed accordingly without any cost.
The C.C is disposed of. Supply free copies of this order to both the parties at an early date
