Smt. Jigeesha Mishra, President : - This is the case of complainant alleging deficiency in service  against the O.Ps. with harassing intentionally.                                                                                                            

In brief, fact of the case is that, the complainant is a business man obtain loan from banks time to time. The O.Ps. are regularly harassing and forcing the complainant for payment of loan amount against the loan account No. LAWJHA00002239050. The complainant stated that the O.Ps have entered the name of the complainant in CIBIL account to harass the complainant. Further it is stated that the O.Ps. have not granted loan to the complainant for which the complainant suffered a lot, hence this case.

The O.Ps. after being noticed appeared and file their written version. The O.Ps. stated in their joint version that, there is no ill intention  on the part of the O.Ps.  It is happened due to similar name and address of the complainant with the guarantor of the said loan bearing No. LWJHA00002239050.  The O.P has rectified the error after knowing the fact. 

Heard from both the sides in length. Disbursement of loan is discretion of the Bank.  In the present case the complainant has not taken any loan from the O.Ps.  There is not any contract between the parties.  The complainant is not a consumer of the Opposite parties under section-2(7) of the C.P.Act, 2019. Hence the case is not maintainable. Accordingly the case is dismissed.

Order pronounced in the open court today the 14^th day of September’ 2022 under my hand and seal of this Commission.
