Case record taken up today for hearing. Complainant is absent  ton call. O.P is present. However, in view of Sec 38(3)(c ) of C.P Act 2019 case record is taken up for disposal on merit after hearing Learned counsel for O.P present.

The complainant has presented this complaint allegation deficiency in service  for transfer of payment from his saving account towards credit card dues and on being aggrieved on the demand notice dt.26.11.2021 of O.P 1.

Perused the complaint petition written version and documents filed by both the parties.

It appears that the complainant is remaining absent consistently . No cogent evidence is adduced to substantiate his claim. Law is well settled that mere pleading is not taken as evidence. Onus lies on the complainant to prove the allegation made against the O.Ps. Hence , we are of the opinion that the complaint sans merit . Accordingly dismissed against the O.Ps . However no order as to cost.
