Final Order / Judgement

MR. BIBEKANANDA  DAS, MEMBER:-         

                     This C.C.Case No. 46/2022 has been filed U/s-35 of C.P.Act, 2019 seeking following relief:-

                     Honbl’e Commission may direct the Op to provide no objection certificate in favour of the Petitioner in respect of A/C No. 0328675100001953 mentioning that the Petitioner has taken no loan in respect of said Account.

                       Notice to Op was issued on dt. 02.02.2023 but non appeared on behalf of the Op and Op is set ex-parte on dt. 21.09.2023.

             The grievance of the Complainant is that, when he applied for a loan to the Axis Bank, Salipur, Complainant was told that you have taken loan utilizing your PAN Card against loan A/C No. 0328675100001953 against Mahindra XUV 500R FWD bearing Regd. No. OD-01K-2229. But the Complainant alleged that he has not taken any loan. Both the parties are absent for which we are not able to know the exact status of the case.

             We therefore direct the Complainant to make an application to the Ops along with the copy of this order and the Ops on receipt of application of the Complainant shall take appropriate step in accordance with rules. Besides that we find no deficiency in service on part of the Ops or any consideration  paid by the Complainant and it is a case of forgery and cheating and this commission has no jurisdiction to adjudicate the same. However taking a lenient view we have already directed to settle the grievance and give suitable reply/step and communicated the same to the Complainant within a period of 90 days from the date of receipt of this order.

            With the aforesaid observation the C.C.Case No. 46/2022 is accordingly disposed off. No order as to cost.

                                Issue extract of the order to the parties concerned.   

           Pronounced in the open Commission, on this the 17th   day of October,2023.
