This C.C.Case No. 13/2023 has been filed U/s-35 of C.P.Act, 2019 seeking following relief:-
Honbl’e Commission may kindly admit the C.C.Case, issue notice to Op & adjudicate my grievances as per law.
The brief fact of Complainant is that he had taken loan from Op & 8 yrs back and Bank Manager told said his loan was cleared in 2016 and there is no outstanding amount pending and he has nothing to pay in KCC loan A/C No. 30684692920 and alleged misappropriation of his money (amount), forgery of his signature and prayed to adjudicate his grievance as per law.
Op has filed written version objecting the prayer of Complainant and stated that loan A/C No. 30684692920 turned to NPA due to default of complaint in making payment of loan dues in the manner agreed upon and by issuing notice to Complainant cannot be construed as deficiency of service in any manner and he is a defaulter.
The Complainant has not filed a single document with regard to payment of loan and alleges forgery and misappropriation for which this Commission has no power for adjudication and there is no deficiency in service by Bank by issuing the Advocate notice.
Hence we find no merit in the C.C.Case and the C.C.Case No. 13/2023 is hereby dismissed and accordingly disposed off. No order as to cost
