Complainant has filed the C.C.Case No. 93/2023 U/s-35 of C.P.Act, 2019 seeking following relief:-
Hon’ble Commission may direct the Ops to pay the matured value with all interest to the Complainant’s Account and Rs. 1,00,000/- towards the compensation to the Petitioner for financial loss, mental agony”.
Non-payment of maturity claim is the grievance of complainant in respect of her Term Deposit Certificate bearing No. 322500DP0022556. The Complainant deposited the amount on 10.10.2017 and in order to encash the certificate, she tendered the certificate in October-2022 but the amount has not been paid to her for which she has filed the consumer complaint as stated by Complainant. The Ops denies to have received the certificate and admit that she is the depositor in respect of Term Deposit No.322500DP0022556.
The Complainant has sent Regd. Notice to Op No.2 on 22.03.2023 with tracking of Post Office but no reply from Ops. So it is crystal clear that, the Ops are negligent in paying the matured amount and even a reply and even caused delay in disposal by disputing typographical error of Complainant of one letter of the Certificate for which we are satisfied that the Ops are negligent in paying the amount of complainant and such act of Ops amounts to unfair trade practice for which we direct the Ops to release the claim matured amount of Complainant with same rate of interest from the date of deposit till date of payment and the Ops shall pay cost of Rs. 5000/- (five thousand) for mental agony and Rs. 2000/- (two thousand) towards cost of litigation cost.
With the aforesaid observation and direction the C.C.Case No. 93/2023 is allowed and accordingly disposed off.
