MR. PRAVAT KUMAR PADHI, PRESIDENT:-
Complainant has filed the C.C.Case No. 38/2023 U/s-35 of C.P.Act, 2019 seeking following relief:-
Hon’ble Commission may direct the Op Bank to provide appropriate documents to Complainant and release the certificate and also release free his held up account and Rs. 30,000/-to award the compensation to the Petitioner for financial loss, mental agony”.
Both parties are continuously absent and it appears both parties have no regard to this Commission. We have perused the record, no written version has been filed by the Op though Mr. D.K. Kar, Adv. filed the Vakaltanama on dt. 03.04.2023 and time was allowed on dt. 04.08.2023 for filing written version. Complainant is also equally not interested for his case and has not filed a single document in support of his case, who has prayed to release his certificate and to free his held up Account.
There is not a single document supporting sanction of loan, repayment of loan and any application by the Complainant to Ops to release his certificate after payment of bank dues. Thus we find no merit in the consumer complaint & accordingly the C.C.Case No. 38/2023 is hereby dismissed. No order as to cost.
