This C.C.Case No. 44/2023 has been filed U/s-35 of C.P.Act, 2019 seeking following relief:-
Hon’ble Commission may direct the Ops to produce guideline of Coir board and illegal, misappropriated money for which complainant not responsible have no obligation to pay such amount except Rs. 83,000/-. Further the Complainant prayed for Rs. 15,00,000/- (Fifteen Lakhs) as mental agony and Rs. 1,00,000/- (One lakhs) for litigation cost and no extra loan amount except Rs. 83,000/-.
Complainant though filed hazira is found absent on repeated calls and we heard the Ld. Counsel for Op-Bank.
From the prayer, we do not understand the meaning of the prayer except payment of Rs. 83,000/- by the Complainant to the Bank and claim of Rs. 15,00,000/- as mental agony and Rs. 1,00,000/- for cost of litigation.
Relationship between Complainant and Ops are that of debtor and creditor and there is no element of deficiency in service and there is also no proof regarding transaction of both the parties.
We therefore find no merit in the C.C.Case and the C.C.Case No. 44/2023 is hereby dismissed. No order as to cost.
Issue extract of the order to the parties concerned.
