Final Order / Judgement

MR. PRAVAT KUMAR PADHI, PRESIDENT:-

                Complainant has filed C.C.Case No. 56/2022 U/s-35 of C.P.Act,2019 before this Commission seeking following relief:

                “ Honbl’e Commission may kindly issue necessary direction to the Ops to disburse the death benefits of deceased husband of the Complainant along with litigation expenses and compensation of mental agony and irreparable loss”.

                Brief fact of this case is that the husband of Complainant taken 2 Policies from Ops bearing Policy No.583955116 & 582121225 under Jeevan Sathi & Jeevan Surakhya Policy. Policy No. 583955116 was settled but Policy No. 582121225 was not settled for which Complainant has filed a C.C.Case on dt. 14.10.2022 and  during pendency of C.C. Case after receipt of notice from this Commission the Policy has been settled and On dt. 15.12.2022, petition has been filed by the Ops stating that Rs. 1,25,193.00 has been paid to Complainant in her account SBI, Paradeep having IFSC Code- SBIN0003945 bearing Account No. 11116902270 on dt. 28.11.2022 which has been credited on 29.11.2022, where after there is no dispute from Complainant as such we find that there is no deficiency in service on  part of the Ops as they have settled the claim immediately on receipt of notice. Hence the C.C. Case  No. 56/2022 is devoid of any merit and is hereby dismissed. No order as to costs.

               Issue extract of the order to the parties concerned.   

           Pronounced in the open Commission, on this the 1st  day of August,2023
