Final Order / Judgement

MR. BIBEKANANDA DAS, MEMBER:-

                   Complainant has filed the C.C.Case No. 115/2023 U/s-35 of Consumer Protection Act, 2019 seeking not to repossess TATA LPT 3518 BS VI COWL bearing Regd. No.OD-09U-2528 and to ply the vehicles & to produce loan account statement and pay compensation as per law.

            Complainant took loan  of Rs. 32,69,164/- on 14.01.2021 to repay in 46 monthly EMI @ Rs.89,797/-commencing from 10.10.2021 to 10.12.2024. Complainant failed to pay and violated the agreement for which on apprehension of repossession complainant has filed the consumer complaint seeking aforesaid relief. We find no merit in the consumer complaint and any deficiency on the part of opposite parties when relationship between Complainant and Ops is that of Debtor and Creditor. Besides that complainant is a defaulter of loan as per agreement and there is no deficiency in service. Even the complainant has failed to carryout the order dt. 02.08.2023 inspite of the protection of this Commission.

            However taking a lenient view we dispose of the consumer complaint directing the opposite parties to supply the account statement and any other document as required by complainant available with opposite parties and may charge the fees to that effect. The complainant shall pay his regular EMI and in addition to that pay 40% within 30 days & rest pending EMI in 15 EMI (i.e, about Rs.36,000/-) in each month towards pending EMI. For failure to pay regular EMI and additional amount as directed above, the opposite parties are free to take action as per agreement/rule/law. With the aforesaid observation and direction the consumer complaint case No.115/23 along with I.A No. 67/23 are disposed of. No cost.  

                                 Issue extract of the order to the parties for compliance.
