Complainant has filed the C.C.Case No. 73/2022 U/s-35 of C.P.Act, 2019 seeking following relief:-
Honbl’e Commission may direct the Ops to compensate the complainant for a sum of Rs. 2 Lakhs towards mental agony and torture, litigation expenses and the insurance claimed amount of Rs. 89,000/-.
Dispute regarding settlement of Insurance claim is the grievance of the Complainant all along mentioned Policy No. 345105/31/2018/1990 in respect of vehicle bearing Regd. No. OD-29A-4712 but the policy No. mentioned in letter dt. 01.10.2021 of Op is 345106/31/2018/1990. Due to such topographical error 5 instead of 6, the claim has not been settled.
Non-settlement of Insurance claim in time on silly mistake amounts to deficiency in service. We therefore direct the Ops to settle the claim in accordance with rules. For harassment, mental agony to Complainant we impose cost of Rs. 3,000/- and impose cost of Rs. 2,000/- towards litigation cost. The Ops are directed to carry out the order within 60 days from the date of receipt of this order.
With the aforesaid direction and observation the C.C.Case No. 73/2022 is allowed and accordingly disposed off.
Issue extract of the order to the parties for compliance.
