MR. PRAVAT KUMAR PADHI, PRESIDENT:-

          The Complainant has filed the C.C.Case No. 128/2023 U/s-35 of C.P.Act, 2019 seeking the following relief:

           “ After hearing the both parties the Hon’ble Commission directed to the Ops  to release of the vehicle No. OD-29H-7249 (Truck) to the complainant and passed an appropriated order not to transfer the vehicle till final disposal of case. Further directed to the Op-3 not to transfer the ownership till final disposal of the original C.C.Case”.

Final award under Arbitration and Conciliation Act-1996 has been passed on 31.01.2023 i.e, much prior to filing of this case before this Commission on dt. 28.08.2023. As such the consumer complainant is not maintainable.

As such we find no merit in the consumer complaint and accordingly the C.C.Case No. 128/2023 alongwith I.A No. 77/2023 are hereby dismissed. No order as to cost.

                         Issue extract of the order to the parties concerned.
