This C.C.Case No. 67/2023 has been filed U/s-35 of C.P.Act, 2019 seeking following relief:-
Honbl’e Commission may direct the Op to receive the default amount of Rs. 21,057/-(3 monthly default installments) from the Complainant & direction to the Op for pay Rs. 50,000/- towards mental agony & Rs. 10,000/- towards litigation of cost.
Brief fact of the Case is that Complainant in order to maintain her livelihood she purchase one Auto bearing Regd. No. OD-29F-8125 being financed by Op amounting Rs. 2,16,115/- on dt. 18.03.2019 and to repay the loan in 48 EMIs during the period from dt. 18.03.2019 to 21.08.2023 during which Covid-19 broke out & Complainant availed the moratorium facility thus period of repayment is to be extended for 6 months i.e upto Feb-2024 but Complainant is ready and willing to settle the loan by paying entire amount towards interest upto Oct-2023.
Taking into consideration of the undisputed fact and grievances of Complainant and her willingness to clear the entire loan, we dispose of the C.C.Case & directing the Ops to accept the entire amount and deduct some ODI/Addl. interest and other charges and after receipt of the entire amount, issue No Objection Certificate (NOC) within 15 days from the date of receipt of entire amount.
With the aforesaid observation and direction the consumer complaint case No.67/23 along with I.A No. 35/23 are disposed of. No order as to cost
Issue extract of the order to the parties concerned.
