Complainant has filed the C.C.Case No. 176/2023 U/s-35 of Consumer Protection Act, 2019 seeking not to repossess 3718 BS TV bearing Regd. No.OD-05-AD-2691and to release the vehicle and pay compensation of Rs. 1,20,000/-
Complainant took loan of Rs. 27,25,000/- on 18.09.2017 to repay in 80 monthly EMI @ Rs.59,950/- commencing from 21.04.2017 to 21.04.2024. Complainant failed to pay and violated the agreement for which on apprehension of repossession complainant has filed the consumer complaint seeking aforesaid relief. The complainant is a defaulter of loan as per agreement and owner of multiple vehicles as such the same is liable to be dismissed but the Ld. Counsel for Complainant submitted that he is ready to clear the entire dues but some time may be given.
Taking a linnet view we dispose of the consumer complaint directing the complainant to pay his 50% of pending EMIs within 15 days of Communication of outstanding dues to be intimated by Ops within 10 days of receipt of this order and rest 50% to be paid within 2 months thereafter. For failure to pay EMI amount as direct above, the Ops are free to take action as per rule/law/agreement.
With the aforesaid observation and direction the C.C.Case No. 176/2023 is accordingly disposed of. No order as to cost.
Issue extract of the order to the parties for compliance.
