Hazira is filed on behalf of the complainant through advocate.

No step is taken by the O.P./Bank.

The case is fixed for submission of written version I/D Ex-parte hearing. The case is therefore taken up for Ex-parte hearing.

            The complainant’s case is that on 02-07-2018 United India Insurance Company transferred an amount of Rs.56,264/- towards the Mediclaim of the complainant through the Account of the son of the complainant namely Sri Benoy Mukherjee vide Account No.263310100001857. On the same date the said Benoy Mukherjee issued a Cheque of Rs.56,264/- vide No.000028 drawn on Andhra Bank, Bankura Branch in favour of the complainant for receiving the said amount and the complainant submitted the said cheque with his Banker, IDBI Bank, Bankura Branch for encashment. But on 04-07-2018 the IDBI Bank, Bankura returned the said cheque with the remark that the said cheque has been dishonored by Andhra Bank, Bankura with the reason ‘Account Blocked’. The complainant has therefore approached this Commission for proper direction upon O.P./Andhra Bank so that the complainant receives Rs.56,264/- to his Account.

O.P./Andhra Bank, Bankura has not come forward to contest the case by filing any written version.           

            On perusal of the return Memo sent by IDBI Bank, Bankura to the complainant it reveals that the cheque has been dishonored by Andhra Bank with the remark ‘Account Blocked, situation covered in 2125’.

            O.P./Andhra Bank, Bankura has not come before this Commission to clarify the expression in the remark column ‘situation covered in 2125’ and the Commission also finds no explanation from the complainant as to what does it actually mean.

            The complainant has to satisfy the Commission regarding actual reason for dishonor of the cheque by the O.P./Bank and in absence of such explanation and clarification on record the Commission will dare not to pass any order in this regard. Another striking feature in this case is why the complainant avoided to receive payment of his medi-claim benefit direct to his account when he has an account with IDBI Bank. Son of the complainant Benoy Mukherjee may be advised to arrange payment of the said amount to his father/complainant in other way. Without ascertaining the actual reason for blocking the account of the son of complainant it would not be wise for the commission to pass any order as it may interfere with the internal administration of the Bank.

            Accordingly the case is disposed of with the above observation.

            Both parties be supplied copy of this order free of cost.
