MR. BIBEKANANDA  DAS, MEMBER:-       

            Without   entering into the merit of the case, as agreed   by both parties the C.C.  is  disposed   of  with  direction  that Complainant  shall pay Rs. 1,10,000.00 only  (Rupees  One lakh  Ten thousand)only (earlier paid  Rs.90,000/-  as per  order dt. 06.02.2024). Thus  total Rs.2,00,000.00 (Rs. Two lakh) have to be paid by the Complainant within 10 days including  earlier Rs. 90,000/- already deposited.

 After release of vehicle bearing Regd. No. OD-05Q-5825 (Truck) the  Complainant shall pay his  regular  EMI  and pay additional   twenty  thousand (Rs.20,000.00)  out of arrear amount  in each month along with regular EMI and if the Complainant   pays    the EMI  and arrear amount   regularly   then  2/3^rd  of  over dues  interest charges (ODI)shall be deducted  by the Opposite  Party.  The    Complainant shall pay the stockyard   charge and repossession charges at the time of release of vehicle as he is a  defaulter .

With the aforesaid observation and direction the C.C.Case No. 16/2024 is  accordingly  disposed off.
